Facts:
The Requestor is a worldwide famous manufacture of domestic appliance. Its trademark ¡°PHILIPS¡± is a well-known trademark recognized by the world and has been registered in China.
In 1994, the Requestor found that as a State owned enterprise, XX Company of Jiaxin City organized to produce actually 450,000 pieces of counterfeiting PHILIPS¡¯ fluorescent lamp starters. These counterfeiting goods were sold by the above-identified infringer in China and even to abroad.
The infringer¡¯s acts were obviously a kind of deed infringing the exclusive right of the registered trademark intentionally. On the one hand, it aggrieved the Requestor¡¯s reputation and interests; on the other hand, it also injured the Chinese consumers¡¯ interests. In this case, the infringer¡¯s selling counterfeiting products abroad, made more serious effects to the Requestor and China¡¯s international reputation.
Consequently, AA Company entrusted the agent of Our Company to make complaint to the Administration for Industry and Commerce of Jiaxin City, Zhejiang Province.
Settlement:
Under the coordination of the Administration for Industry and Commerce of Jiaxin City, the infringer pledged not to produce and sell any infringing products ( see the Letter of Guarantee).The infringer has been imposed a fine and ordered to pay the compensation for the loss of the Requestor.
