Brief Introduction to the Case
The requester, AA Company is the patentee of the patents for industrial design CN 88300178, CN 88300179 and CN 94303098. The patentee found that the above infringer was producing and selling electric irons having the same design with the above patentee’s patents without the permission of the patentee. Thus, it infringes the patent right belonging to the patentee. This made the consumers confuse the infringing products with the patentee's products, leading to the wrong purchase. As a result, the interests of the vast consumers were damaged and the reputation of AA Company was also seriously damaged. Therefore, the attorney of our Company was consigned by the patentee to ask an action with the Guangdong Provincial.Patent Administrative Office.
Results
As requested by AA Company, the Guangdong Province Patent Administrative Office made an investigation and mediation on the above case in August, 1995. Finally, the two parties reached the following agreement:
1.The infringer immediately stoped producing and selling the products infringing patent right and sealed up the existing products;
2.Destroyed all illegal products and related packages and instructions thereof;
3. Destroy all the moulds and other tools concerned for making the products;
4.The infringer should pay a compensation of ￥90,000(RMB) to
AA Company.
