The Brief Introduction of The Case
The requester is the owner of the design patent ZL97310563.1 in China. The above infringer produced and sold magnifying glasses which were similar with the patentee¡¯s patent without patentee¡¯s permission. It infringed the patentee¡¯s design patent right. This act easily made the consumer confused to distinguish the difference between the infringement products and the patentee¡¯s products, and led to consumers¡¯ wrong purchase. As a result, the great consumers¡¯ interests and AA Company¡¯s reputation were damaged. Consequently, AA Company consigned the attorney of our Company to ask an act with the Zhejiang Province.Patent Administrative Office.
The Transaction of the Case
According to the demand of patentee, the Zhejiang Province.Patent Administrative Office made an investigation in November, 1998. Under the intercession of the authority, the both sides came into a pacification agreement at last. In the agreement, it pointed that, the trespasser should stop producing and selling the above illegal products immediately, and destroy all illegal finished products and unfinished goods, destroyed the moulds and other concerned tools. The trespasser should compensate AA Company for 2,000(RMB). Detailed content is in the pacification agreement signed by both sides.
